Texas’s negligence laws operate under a modified comparative negligence system, meaning you must be less than 51% responsible for an accident to claim monetary compensation. Unlike in other states, Texas uses the comparative fault system, meaning more than one party could be assigned blame.
Is Texas an At-Fault State?
Texas is an at-fault state, meaning that if you’re involved in an accident, the party at fault must cover your losses.
For example, if you were injured in a car accident, you would file a claim against the at-fault driver’s insurer. It would be up to them to provide a suitable settlement, or you could file a personal injury claim.
This system contrasts with the minority of states that are classified as no-fault states. Under the same circumstances, you would file a claim against your own insurance company, regardless of who’s at fault.
